Privacy Policy for Applicants

The protection of your privacy and personal data is very important to the Akom Group member companies (hereinafter referred to as “we,” “us,” “our,” and “Akom”).

We would like to inform you about how your personal data will be used during the application process for positions as an employee, expert, or consultant, and what rights you have.

The processing of your personal data takes place in accordance with the EU General Data Protection Regulation and the applicable data protection laws in the jurisdictions where Akom operates.

1. Who has control over your data?

The member Akom Group companies (listed below) are committed to protecting and respecting your personal data.

Whenever you apply for positions at any of the Akom Group member companies, the respective member company is the “data controller” for your personal data.

2. How do we use your data?

3. What personal data do we collect?

Within the recruitment process, we collect and store the following categories of personal data about you:

  • Data which you have provided to us such as first and last name, e-mail, date of birth, phone number, address
  • Data which you have provided to us in your application documents (curriculum vitae CV, cover letter) including work experience, qualifications and language skills.
  • Voluntarily provided information by you (not required for the recruitment process) including your areas of interest, photo, family situation or marital status, sensitive information such as your ethnic background or health information etc.

The provision of your personal data is necessary for the implementation of the application process and for the decision on the conclusion of an employment or framework or consultancy agreement with you.

If you do not provide us with all the personal data required for the application process when you apply, we will not be able to consider you in the application process.

4. Who may receive your data? Where may your data be transferred?

4.1. Your personal data will not be disclosed to third parties except the following recipients:
  • Other Akom Group Member Companies where necessary for administrative purposes, operative personnel management
  • Our third-party service providers on behalf of Akom that may contract you as a consultant for providing customer services on behalf of our clients.
  • Third party service providers on behalf of Akom such as providers of IT services, website hosting and management, data analysis, data back-up, security and storage services, recruitment agencies/platforms, providers of legal or accounting professional services  in so far as it refers to recruitment process;
  • To our clients for business operations purposes, performance and quality evaluation, confidentiality and information security measures
  • Governmental or regulatory authorities, courts and law enforcement authorities or agencies as required by and/or in accordance with applicable law or regulation

We ensure that all our third party service providers provide adequate safeguards for the protection of personal data and process personal data transferred to them only in accordance with Akom’s documented instructions based on a data processing agreement, and to flow the same obligations down to their sub-processors.

4.2. Your personal data may be transferred to countries outside the European Economic Area (EEA) – third countries, based on:

  • European Commission’s adequacy decision (applies for countries, which are subject of decision) or a adequacy decision issued by other data protection supervisory authority in jurisdictions where Akom operates 
  • Standard data protection clauses (SCC) adopted by the European Commission or by other data protection supervisory authority in other jurisdictions where Akom operates. 
  • Other appropriate legal safeguards for transfer of data in accordance with the GDPR or other applicable data protection laws where Akom operates. 

5. Automated decision-making

You will not be subject to decisions that will have a significant impact on you based solely on automated decision-making.

6. How long do we retain your data?

Your personal data will not be kept longer than the duration of the recruitment process and for 6 months thereafter. Based on your explicit consent, we may retain and use your personal data for additional 6 months following an unsuccessful application, for the purpose of contacting you in the event that any similar jobs/roles become available from time to time.

7. How do we collect personal data?

We collect personal data about candidates from the following sources:

  • You, the candidate
  • Employment agency or platform or a recruiter (if used by the Akom member company)
  • If you have a publicly visible profile on career portals (e.g. LinkedIn etc.) or if you disclose your profile to us as part of the application process
  • Third party service reports for example, where an occupational health assessment is required by law, but only if this is required for the employment process and once we have discussed this with you.

8. What rights do you have?

In accordance with processing your personal data you have the following rights:

  • Right of access, rectification (updating), erasure
  • Restriction of processing: in certain cases, you can request that the processing of your data be restricted.
  • Data portability: If you have provided data on the basis of a contract or consent, you can request that you receive the data you have provided in a structured, common and machine-readable format or that it be transmitted to another responsible party.
  • Right to object profiling;
  • Right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
  • You have the right to object at any time to the processing of personal data based on a legitimate interest, for reasons arising from your particular situation. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms.

You have a right to lodge a complaint to us at any time if you object to the way in which we have used or managed your personal data using the contact information above in section 1.

Where you are dissatisfied with our response, you also have the right to escalate your complaint to the relevant regulator (data protection supervisory authority) corresponding to your residency, and further information for contact can be located on the applicable regulator ’s website.
